In February, the Research Report on Key Issues in the Protection of Artificial Intelligence User Rights and Interests (hereinafter referred to as “the Report”) was officially released. Jointly researched and compiled by the Intellectual Property Working Committee of the Internet Society of China (hereinafter referred to as“the Working Committee”) and Du Xiaoman Technology (Beijing) Co., Ltd., the Report aims to systematically address new challenges in user rights protection brought by the wide application of artificial intelligence technologies. It provides an important reference for clarifying the boundaries of user rights protection, defining artificial intelligence governance paths, and building a trustworthy, controllable and responsible AI industrial ecosystem.

Based on a systematic review of domestic and international practices in the protection of AI user rights, the Report focuses on four types of high-risk scenarios involving new infringements on user rights: data collection and training, non?compliant generated content, biased algorithmic decision?making, and cybersecurity vulnerabilities. It conducts an in-depth analysis of the mechanisms of rights infringement and governance difficulties in these areas. From the perspective of collaborative governance, including improving legal protection, strengthening supervision and regulation, and innovating technical support, the Report puts forward a series of targeted and operable countermeasures and action frameworks.
